Whiting Law Group secured a $10.5 million settlement for injured car passenger in collision with semi truck of a top 100 motor carrier. On the day of the crash, the plaintiff was a passenger of a vehicle traveling on road when a semi truck traveling from the opposite direction made a left turn right in front of the plaintiff’s vehicle causing a serious collision. Plaintiff was rushed to the emergency room and later was diagnosed with a traumatic brain injury, and a fractured left forearm that required surgical intervention for repair. These injuries turned out to have permanent life changing effects forcing the plaintiff to have to give up working, driving, and the ability to enjoy life.

Over the course of 3 years, Tim Whiting and Allison Hostetler fought hard for the plaintiff. They argued that the defendant truck company and its driver were negligent in failing keep proper lookout for oncoming traffic which had the right-of-way, while making a left-hand -turn in his tractor and trailer. Additionally, they were able to establish through relentless investigation that the large truck company failed to implement adequate policy, procedure and/or performance standard to ensure that its truck drivers performed their job in accordance to FMCSA safety regulations, and failed to ensure the defendant driver at the time was emotionally fit, and cleared for the safe operating of its tractors and trailers on the roadway. Due to our pursuit of justice, we were able to recover a settlement in the amount of $10.5 million prior to trial against a major freight company in the United States.
