In the fall of 2020, 38-year-old Plaintiff was driving to work in Sand Springs, Oklahoma, when his vehicle was struck by a commercial tanker truck. The defendant driver had exited the highway and was stopped at a red light in the middle lane of the ramp, which was designated for through traffic only. As Plaintiff lawfully proceeded through the intersection, the tanker turned across his path of travel and struck the passenger side of Plaintiff’s vehicle.As a result of the crash, plaintiff claimed traumatic brain injury, post-concussive syndrome, headaches, cognitive and memory deficits, aggravation of PTSD, anxiety, depression, neck injury, back injury, and aggravation of pre-existing spinal conditions. Attorneys for Plaintiff argued that the defendant driver failed to follow clearly marked lane directions, ignored roadway signs and markings, and violated basic commercial driving safety rules. Plaintiff further alleged that the defendant driver violated Oklahoma and Federal ordinances by attempting an unsafe left turn from a lane that was not lawfully available for that movement, constituting negligence. The defense disputed liability and argued that the plaintiff was traveling too fast under the circumstances and had the last clear chance to avoid the collision. The case resolved through a settlement for $2.4 million.
