Whiting Law group is thrilled to share news of a significant achievement: securing a $2 million settlement in a crucial case. On the evening of January 4th, 2018, our plaintiff, a 27-year-old male, was driving his passenger vehicle northbound on 3000 E Road, in Manteno Township, IL. While driving northbound, the plaintiff ran into the defendant’s semi-trailer that separated from the tractor while exiting the defendant’s terminal parking lot. As a result of the collision, the plaintiff’s vehicle was partially lodged under the trailer causing the plaintiff to sustain serious injuries. The plaintiff was rushed to the emergency room under life threatening conditions and received treatment for a 12cm laceration to the left side of his neck and deformities sustained to his left wrist and face. The plaintiff was later diagnosed with brachial plexus injury and PTSD. Counsel for the plaintiff, Tim Whiting and Torrie Poplin, argued that the defendant failed to perform an adequate semi-tractor and trailer pre-trip inspection that would have prevented the uncoupling of the trailer to the tractor, and failed to place triangles, lights, or other devices on the road way to warn incoming motorists of the dangerous condition after the trailer became separated from the truck. Defendants argued that the plaintiff should have seen the trailer across his lane of travel and failed to reduce his speed to avoid hitting the trailer.
