We are proud to announce that Tim Whiting and Torrie Poplin were able to secure a $3 Million settlement for a family that was involved in a fatal collision against a commercial motor vehicle on a interstate road. The accident occurred as a result of a passenger vehicle veering to the right side of the roadway striking the rear end of a trailer parked on the paved shoulder. As a result, one of the passengers died at the scene, another passenger sustained rib fractures, and lastly, a minor passenger sustained fractures to his left hip, pelvis, and arm that ultimately required surgical intervention for each fracture. Whiting Law Group argued that that defendant parked its truck and trailer along and upon the interstate roadway in violation of Federal Safety Regulations, State Law, company policy, and company procedures. Plaintiff also argued that the defendant’s driver also failed to place the required warning devices and trailer lights, causing the vehicle the plaintiff’s were in to strike the trailer. Attorneys for defense argued that the passenger vehicle driver was responsible for the crash by failing to maintain a proper lookout for conditions on or near the roadway, operated the vehicle at a speed that was greater than necessary, failed to keep the vehicle on the roadway and proper control, and failed to take evasive action to avoid a collision with the trailer. For these reasons defense argued that defendant driver exceeded 50% of the cause. This matter concluded via mediation.
