Katherine Cancello earns Board Certification as a Truck Litigation Paralegal by ATAA

Tim Whiting to Speak at ATAA’s 2023 Symposium in Atlanta

Tim Whiting has been invited to share his expertise and insights on trucking cases involving improper truck loading. This event promises to be a great opportunity to contribute to the education of attorneys handling similar types of truck loading cases on their own to help maximize justice for their clients.

$4 Million Settlement

We are excited to announce that Whiting Law Group secured a $4 million settlement for victim of truck wreck. On the day of the accident, 70-year old plaintiff was driving vehicle westbound on I-88 when his car was rear ended by defendant driving a commercial motor vehicle. As a result of the collision, the plaintiff driver died from his injuries shortly after he was rushed to the emergency room at nearby hospital. Attorneys Tim Whiting and Torrie Poplin argued that the defendant truck company did not have adequate performance standards in place to ensure it hired and retained competent truck drivers and that its commercial truck drivers did not perform their job duties in accordance with the FMCSA safety regulations. Whiting Law Group was able to secure a settlement in the amount of $4 million for plaintiff’s surviving family.

Whiting Law Group and DK Global partner to create state-of-the-art animations leading to $5M settlement

Tim Whiting has been featured in an interview produced DK Global’s Golden Advocate Awards for the creation of 3D animations that aided to the settling of a $5M case. Under the direction of Tim Whiting and a team of truck accident experts and brain injury experts, DK Global created two presentations. The first set out to establish the Defendant’s liability, and the second animation showed the plaintiff’s damages. Tim Whiting to Speak at South Carolina Seminar

We are excited to announce that Tim Whiting will be participating as a featured speaker at the South Carolina Bar-Continuing Legal Education Division’s Handling a Truck Accident Case From Sign Up Through Trial seminar. This event will be taking place on February 21, 2023 and it is exclusive for plaintiff personal injury attorneys especially those handling a truck accident cases and are looking to gain more knowledge in the field.

Tim will be sharing his insights an experience dealing with cases where driver qualifications and negligent hiring and supervision claims were at question. This is a unique opportunity to hear from many leading voices in the industry and gain valuable knowledge and inspiration. Whiting Law Group is very proud of being a part of it.

$10.5M Settlement

Whiting Law Group secured a $10.5 million settlement for injured car passenger in collision with semi truck of a top 100 motor carrier. On the day of the crash, the plaintiff was a passenger of a vehicle traveling on road when a semi truck traveling from the opposite direction made a left turn right in front of the plaintiff’s vehicle causing a serious collision. Plaintiff was rushed to the emergency room and later was diagnosed with a traumatic brain injury, and a fractured left forearm that required surgical intervention for repair. These injuries turned out to have permanent life changing effects forcing the plaintiff to have to give up working, driving, and the ability to enjoy life.

Over the course of 3 years, Tim Whiting and Allison Hostetler fought hard for the plaintiff. They argued that the defendant truck company and its driver were negligent in failing keep proper lookout for oncoming traffic which had the right-of-way, while making a left-hand -turn in his tractor and trailer. Additionally, they were able to establish through relentless investigation that the large truck company failed to implement adequate policy, procedure and/or performance standard to ensure that its truck drivers performed their job in accordance to FMCSA safety regulations, and failed to ensure the defendant driver at the time was emotionally fit, and cleared for the safe operating of its tractors and trailers on the roadway. Due to our pursuit of justice, we were able to recover a settlement in the amount of $10.5 million prior to trial against a major freight company in the United States.

Tim Whiting Speaks at Trial Lawyers University (TLU) 2022 at Las Vegas, NV

Tim Whiting was invited to be a speaker at this year’s Trial Lawyers University convention in Las Vegas, NV. During this year’s convention, Tim Whiting was a part of an array of experienced trial attorneys who presented on various topics to the end of helping PI attorneys be better trial attorneys and better advocates for their injured clients. Additionally, Tim had the opportunity to coach one-on-one attendee attorneys handling trucking cases via breakout sessions. Attendees had the opportunity to ask questions regarding their own trucking cases and seek ways to overcome challenges posed by the at fault parties in a case.

Tim Whiting presents at Strafford Webinar’s Deposing Truck Drivers in Injury Cases

Strafford Webinars invited Tim Whiting to speak at their educational webinar panel event that took place on November 2, 2022. Tim and panel members presented on how a PI attorney representing victims in trucking cases should prepare on how to depose truck drivers and trucking company representatives. The webinar discussed the best practices for effectively questioning deponents, videotaping driver depositions, using demonstrative exhibits, dealing with complex drivers or trucking company representatives, and raising and defending objections.

The panel also discussed skillfully navigating Rule 30(b)(6) of the Federal Rules of Civil Procedure when preparing deposition notices for trucking company corporate representatives.
