On the afternoon of October 23, 2019, plaintiff driver (female) was driving eastbound on Interstate 94 accompanied by her four daughters. While on the left lane of the interstate, a commercial motor vehicle driver recklessly switched lanes ignoring adjacent plaintiff’s vehicle to its left side. The action caused plaintiff to veer her vehicle to the shoulder median resulting in a collision against an impact attenuator and concrete barrier. Ensuing the collision, a second passenger vehicle crashed against plaintiff’s. It was later noted that the passenger vehicle was driving closely behind. The collisions were fatal in nature, resulting in the death of a minor passenger. Plaintiff driver sustained a lumbar spine injury with radiating pain to the right leg, and attended treatment for PTSD and depression; injuries among other passengers (minors) include but were not limited to mild traumatic brain injury, back injury, hip injuries, lacerations. Counsel for plaintiff argued that defendant driver was negligent by: 1. failing to operate the commercial motor vehicle at a speed that was reasonable; 2. failing to choose a safe gap for changing lanes; 3. failing to use proper lookout and mirror to ensure a safe gap existed as was legally required; and 3. failing to use signal to indicate to other drivers on the roadway if defendant driver’s intent to make a lane change. Defense argued that since defendant CMV driver did not collide with plaintiff’s vehicle, it was not directly responsible for the collision against the barrier and the aftermath of the second collision with third party defendant. Total Paid: $1,100,000.00

$1.35 Million Settlement
Whiting Law Group is proud to announce that Tim Whiting and Torrie Poplin were able to secure a $1.35 Million Settlement for 20 year old plaintiff involved in a truck wreck on interstate road. On June 19, 2019, plaintiff was driving on I-94 Northbound when a median barrier was pushed onto the lane by a box truck after colliding against it. The defendant driver had lost control of his box truck while attempting to switch lanes and trying to correct its trajectory. Plaintiff collided against the median barrier that was pushed and caused him to sustain severe injuries that required surgical intervention in his right hip, right wrist, and right ankle. Whiting Law Group argued that the defendant driver was negligent in the following ways: he failed to manage and/or control the box truck, he failed to operate the box truck at the speed that was reasonable and prudent to avoid collision, and failed to keep a proper visual search, lookout, and space management to avoid a collision. Counsel for defendant argued that any injuries or damages sustained by the plaintiff was caused by the plaintiff’s own negligence or the negligence of others for whom the defendant was not responsible. The case settled for the policy limit of $1,350,000.00.
$3 Million Settlement
We are proud to announce that Tim Whiting and Torrie Poplin were able to secure a $3 Million settlement for a family that was involved in a fatal collision against a commercial motor vehicle on a interstate road. The accident occurred as a result of a passenger vehicle veering to the right side of the roadway striking the rear end of a trailer parked on the paved shoulder. As a result, one of the passengers died at the scene, another passenger sustained rib fractures, and lastly, a minor passenger sustained fractures to his left hip, pelvis, and arm that ultimately required surgical intervention for each fracture. Whiting Law Group argued that that defendant parked its truck and trailer along and upon the interstate roadway in violation of Federal Safety Regulations, State Law, company policy, and company procedures. Plaintiff also argued that the defendant’s driver also failed to place the required warning devices and trailer lights, causing the vehicle the plaintiff’s were in to strike the trailer. Attorneys for defense argued that the passenger vehicle driver was responsible for the crash by failing to maintain a proper lookout for conditions on or near the roadway, operated the vehicle at a speed that was greater than necessary, failed to keep the vehicle on the roadway and proper control, and failed to take evasive action to avoid a collision with the trailer. For these reasons defense argued that defendant driver exceeded 50% of the cause. This matter concluded via mediation.

We are pleased to announce that Tim Whiting delivered an informative presentation at Florida Justice Association Advanced Trucking Seminar in Daytona Beach Shores on April 5, 2024. The presentation provided attendees with a comprehensive overview on how trucking companies should hire truck drivers and how to make a relevant, admissible, and effective case of negligent hiring/retention by truck companies. Tim Whiting Speaks at TTLA Trucking Seminar
We are delighted to announce that Tim Whiting delivered a comprehensive presentation at Tennessee Trial Lawyers Association’s (TTLA) Trucking Seminar in Nashville on March 1st. Attendees of this event were provided with a deeper understanding of the legal landscape governing trucking operations and reliable methods to employ in order to win a truck wreck case. Tim Whiting presented on the topic of truck driver qualifications and delved into the details of when a truck company should know when to hire a truck driver, when to retain a driver, and when to fire a driver. Tim’s expertise and passion for the topic was evident throughout the session, leaving a lasting impression on all participants.

$2 Million Settlement
Whiting Law group is thrilled to share news of a significant achievement: securing a $2 million settlement in a crucial case. On the evening of January 4th, 2018, our plaintiff, a 27-year-old male, was driving his passenger vehicle northbound on 3000 E Road, in Manteno Township, IL. While driving northbound, the plaintiff ran into the defendant’s semi-trailer that separated from the tractor while exiting the defendant’s terminal parking lot. As a result of the collision, the plaintiff’s vehicle was partially lodged under the trailer causing the plaintiff to sustain serious injuries. The plaintiff was rushed to the emergency room under life threatening conditions and received treatment for a 12cm laceration to the left side of his neck and deformities sustained to his left wrist and face. The plaintiff was later diagnosed with brachial plexus injury and PTSD. Counsel for the plaintiff, Tim Whiting and Torrie Poplin, argued that the defendant failed to perform an adequate semi-tractor and trailer pre-trip inspection that would have prevented the uncoupling of the trailer to the tractor, and failed to place triangles, lights, or other devices on the road way to warn incoming motorists of the dangerous condition after the trailer became separated from the truck. Defendants argued that the plaintiff should have seen the trailer across his lane of travel and failed to reduce his speed to avoid hitting the trailer.

$4 Million Settlement
We are excited to announce that Whiting Law Group secured a $4 million settlement for victim of truck wreck. On the day of the accident, 70-year old plaintiff was driving vehicle westbound on I-88 when his car was rear ended by defendant driving a commercial motor vehicle. As a result of the collision, the plaintiff driver died from his injuries shortly after he was rushed to the emergency room at nearby hospital. Attorneys Tim Whiting and Torrie Poplin argued that the defendant truck company did not have adequate performance standards in place to ensure it hired and retained competent truck drivers and that its commercial truck drivers did not perform their job duties in accordance with the FMCSA safety regulations. Whiting Law Group was able to secure a settlement in the amount of $4 million for plaintiff’s surviving family.
